Judge Will Not Block Aggie’s Seat Expansion

MARSHALL, Texas (AP) — A judge has refused to block updated seating for Texas A&M's expanded Kyle Field as some ticketholders fear they could lose their favorite spots.

The Fort Worth Star-Telegram (http://bit.ly/1ASM61M ) reports U.S. District Judge Rodney Gilstrap refused to grant a temporary restraining order or a permanent injunction.

The $458 million expansion of Kyle Field has added about 20,000 seats, to push capacity above 102,500 for the fall season. The lawsuit was filed by three ex-students who contributed heavily to scholarship endowments and expect prime seats and parking.

The judge in Marshall, in an order signed Saturday, says he was not persuaded that the complaint "meets the high bar" to block reseating by the 12th Man Foundation. The nonprofit wants the lawsuit dismissed.

An attorney for the plaintiffs says they'll continue their claim.
